Terms of Use

1. Parties and definitions

These Terms of Use ("Terms") govern the use of the Pickball game and all related services offered at pickball.fun (the "Service") between Pickball, which operates the Service ("Pickball", "we"), and anyone who uses the Service in any way ("User", "you").

• Account: a user record created with a username and password.
• Room: a game session running in one User's browser (the "room host") that other Users join.
• User content: usernames, room names, chat messages and any other text created by Users.
• Game data: statistics, rankings, match records and anything else earned in the game.

2. Acceptance

By ticking the box when creating an account, or by using the Service, you confirm that you have read, understood and accepted these Terms. If you do not accept them, do not use the Service. Your acceptance is recorded electronically.

3. The Service

• The Service is free and in beta. Bugs, outages, data loss and unexpected behaviour may occur.
• The Service is provided "as is" and "as available". Pickball does not guarantee that it will be uninterrupted, error-free, secure or fit for any particular purpose.
• Pickball may change any feature, rule, physics, appearance or behaviour of the Service, suspend it temporarily or end it entirely, without prior notice.
• Player-to-player connections and room games run on Users' own devices and internet connections, whose performance is outside Pickball's control.

4. Your account

• Each Account belongs to one person only and may not be transferred, sold, rented or shared.
• You are responsible for keeping your password secret and for everything done through your Account. Tell us immediately if you notice unauthorised use.
• Offensive, obscene, impersonating, infringing or misleading usernames and room names are not allowed. Pickball may change or hide them, or close the Account.
• Users under 18 may use the Service only with the knowledge and permission of a parent or guardian. Responsibility for use without such permission lies with the User and their parent or guardian.
• You can delete your Account at any time from the Account tab in the game. Deletion cannot be undone; your statistics and game data are deleted too.

5. Your obligations and prohibited conduct

You agree to use the Service only lawfully and in line with these Terms. In particular, the following are prohibited:

• Using cheats, bots, macros, automated play or any tool that gives an unfair advantage;
• Any attempt to disrupt or overload the game, server or network, or to disconnect other Users (including DoS/DDoS attacks);
• Reverse engineering, modifying or trying to get around the Service's code, protocol or security measures, or exploiting a vulnerability instead of reporting it;
• Inflating statistics or rankings through second accounts, arranged matches, deliberate losses or similar means;
• Swearing, insults, threats, harassment, discrimination, hate speech, obscenity and spam;
• Collecting or disclosing other Users' personal data (including IP addresses), or using it for attacks, harassment or any other unlawful purpose;
• Using the Service or Accounts commercially, selling them, or advertising;
• Any conduct that is a crime, is unlawful or infringes the rights of others.

You bear full legal and criminal responsibility for the content you share and your conduct in the game.

6. User content

• For content created by Users, Pickball acts as a hosting provider under Turkish Law No. 5651 and has no obligation to monitor User content in advance or investigate whether it is unlawful.
• Content reported or found to be unlawful may be removed or blocked by Pickball. Send reports to destek@pickball.fun.
• Room chat travels directly between players' browsers and does not pass through Pickball's servers. The Users who write these messages are responsible for them.
• You agree that your username and game data are shown to other Users within the Service (for example in rankings, room lists and end-of-match screens).

7. Sanctions

• If these Terms are breached, or a breach is suspected, Pickball may unilaterally and without prior notice warn, delete or reset statistics, kick, mute, temporarily or permanently ban an Account or IP address, and close the Account.
• Matches are checked automatically by the server; statistics from matches suspected of cheating may not be recorded.
• No rights or compensation may be claimed for Accounts, statistics or game data lost because of a sanction.
• You can appeal a sanction at destek@pickball.fun. Pickball's decision is final.

8. Game data

Statistics, rankings and anything else of value in the game are for entertainment only. They have no monetary value and give the User no ownership or other right. Pickball may change, reset or delete them for balancing, bug fixes, new seasons or similar reasons.

9. Rooms and peer-to-peer connections

Rooms run on the device of the User who creates them (the "room host"), and Users connect to each other over peer-to-peer (P2P) connections. Due to the technical nature of these connections, the IP addresses of Users in the same room may be shared with one another.

Managing a room (kicking, muting and banning players from it) is the responsibility of the room host; Pickball cannot be held responsible for these decisions. A User who joins a room is deemed to accept these terms. A User who misuses other Users' information bears all resulting legal responsibility.

10. Intellectual property

All intellectual and industrial property rights in the Pickball name, logo, interface, graphics, sounds, source code and all other elements of the Service belong to Pickball or its licensors and are protected by law, including Turkish Law No. 5846 on Intellectual and Artistic Works. You are granted only a limited, non-transferable and revocable licence to use the Service personally in line with these Terms. These elements may not be copied, reproduced, modified or distributed without permission.

11. Third-party services

The Service may use third-party services, for example for bot checks and connecting players, and may contain links to external sites such as Discord. These services and sites are subject to their own terms and privacy practices; Pickball is not responsible for them.

12. Limitation of liability

To the maximum extent permitted by law, and except in cases of Pickball's intent or gross negligence, Pickball is not liable for any direct or indirect damage, loss of profit or loss of data arising from:

• interruption, slowdown, malfunction or termination of the Service;
• loss of Accounts, statistics or game data;
• the conduct or content of other Users and the decisions of room hosts;
• problems with the User's device, software or internet connection;
• third-party services and cyber attacks.

As the Service is free, if Pickball is held liable for any reason, that liability is limited to the lowest amount permitted by law.

13. Indemnity

You agree to cover any damage, costs and legal fees Pickball incurs as a result of claims, lawsuits or administrative sanctions brought by third parties or public authorities because you breached these Terms or the law, or because of content you shared.

14. Force majeure

Pickball is not liable for failing to meet its obligations because of events beyond its reasonable control, such as natural disasters, epidemics, war, terrorism, strikes, fire, changes in law, decisions of authorities, internet, infrastructure or power outages, cyber attacks and failures of service providers.

15. Records as evidence

In any dispute arising from these Terms, Pickball's server records, database records, match audit records and electronic correspondence constitute evidence under Article 193 of Turkish Code of Civil Procedure No. 6100.

16. Changes to these Terms

Pickball may change the Service and these Terms, in part or in full, at any time. Changes take effect when published on this page, and the "Last updated" date at the top is renewed. Important changes may also be announced in the game or on the site. It is the User's responsibility to follow changes. Continuing to use the Service after a change means you accept it. If you do not accept a change, stop using the Service and delete your Account.

17. Termination

You may end these Terms at any time by deleting your Account. Pickball may close your Account if these Terms are breached or if the Service is ended entirely. Sections 5, 10, 12, 13 and 15 to 19 survive termination.

18. Personal data

Your personal data and cookies are handled as described in the Privacy Policy.

19. Governing law, jurisdiction and other terms

• These Terms are governed by the laws of the Republic of Türkiye. Subject to mandatory consumer protection rules, the courts and enforcement offices of Pickball's place of residence have jurisdiction over disputes.
• If any provision of these Terms is found invalid, the other provisions remain valid; the invalid provision is replaced by the valid provision closest to its purpose.
• Pickball not exercising a right, or exercising it late, does not mean it waives that right.
• If this translation conflicts with the Turkish Kullanım Koşulları, the Turkish text prevails.
